Terms of Service

Version 1.0. Effective November 5, 2026.

Agreement to these terms

These Terms of Service (the “Terms”) govern your use of the BrightTurn website, the forms and booking tools on it, our free AI visibility audit, and our text message, email, and phone communications (together, the “Services”).

By using the Services, submitting a form, booking a call, or agreeing to receive messages from us, you agree to these Terms. Our Privacy Policy explains how we handle your information. It is a separate document and is not part of these Terms. If you do not agree to these Terms, do not use the Services.

If you use the Services on behalf of a business, you confirm that you have authority to accept these Terms for that business, and “you” includes that business.

You must be at least 18 years old to use the Services. The Services are offered only to people and businesses located in the United States.

Effective date: November 5, 2026.

Who we are

The Services are provided by BrightTurn LLC, a South Dakota limited liability company doing business as BrightTurn Works (“BrightTurn,” “we,” “us,” or “our”). BrightTurn LLC is the only party to these Terms with you.

Changes to these terms

We may update these Terms from time to time. When we do, we will post the new version on this page and change the effective date. If a change affects how we send you text messages, we will tell you before it takes effect. If a change is material, we will also email our clients and anyone who has opted in to hear from us. Your continued use of the Services after a change takes effect means you accept the updated Terms. Changes do not apply to any dispute that arose before the change was posted.

Using the website

You may use the website for lawful purposes and to learn about or request our services. You agree not to:

  • Submit information that is false, or that belongs to someone else without their permission, including another person’s phone number.
  • Interfere with the website’s operation or security, or try to gain access to systems or data you are not authorized to reach.
  • Use automated tools to overload the website, collect personal information about other visitors, or get around our security.
  • Use the website to send spam or unlawful content, or to infringe anyone’s rights.

Search engines and AI crawlers that follow our site’s published rules are welcome.

We may suspend or end your access to the Services if you break these Terms.

Free AI visibility audit

We offer a free AI visibility audit to help businesses understand how they appear in AI search tools. The audit is general information about your business’s online presence at the time we prepare it. It is not legal, financial, or professional advice, and it does not create a client relationship.

AI search tools and the companies that run them change how they work without notice, and we do not control them. We do not promise any particular result, ranking, mention, or level of traffic from the audit or from acting on it.

The free audit is separate from our paid services, including the Visibility Diagnostic. Requesting the free audit does not obligate you to buy anything.

Paid services, including the Visibility Diagnostic, are provided only under a separate written agreement between you and BrightTurn. If that agreement conflicts with these Terms, the agreement controls for the paid services it covers, except that the section on our text messaging program always applies to the texts we send.

Text messaging program

This section explains our text message program, BrightTurn Works Updates. It applies when you give us your mobile number and agree to receive texts.

Two kinds of texts, chosen separately. When you submit a form, you can agree to either or both of the following, each with its own checkbox:

  • Texts about your request. Messages that follow up on something you asked for, such as confirming or reminding you about a booked call, answering your question, or delivering your audit results.
  • Marketing texts. Tips, offers, and updates about our services.

Neither checkbox is ever pre-checked. Agreeing to texts is not a condition of submitting a form, booking a call, or buying anything from us. Accepting these Terms does not sign you up for texts. You sign up only by checking one of the text boxes.

Message frequency. Texts about your request vary based on your requests and activity. Marketing texts are sent no more than 4 times per month.

Cost. Message and data rates may apply, based on your mobile plan.

How to stop all texts. Reply STOP to any text to stop all texts from us. We also honor the replies QUIT, END, REVOKE, OPT OUT, CANCEL, and UNSUBSCRIBE, and any other reasonable request to stop, such as replying to an email or calling us. Replying STOP also stops marketing from us by email and phone. We may send one final text to confirm that you have been unsubscribed.

How to stop marketing. To stop marketing but keep messages about your request, use the marketing-preferences link in any marketing text or email. This stops marketing from us by text, email, and phone. Texts about your request continue until you reply STOP or ask us to stop in another reasonable way. We act right away on requests made by reply keyword, the marketing-preferences link, or an email unsubscribe, and on other requests within 10 business days.

Starting again. If you stopped our texts and want them back, reply START or sign up again on our website. We will not text you again until you do. Replying START turns texts about your request back on. Marketing texts come back only if you check the marketing box again on one of our forms.

Help. Reply HELP to any text for help, or contact us using the details at the end of these Terms.

Your phone number. You confirm that you are the account holder for the mobile number you give us, or that you have the account holder’s permission to use it. If you change or give up that number, please tell us or reply STOP so the next owner of the number does not receive our texts. Our text program is for US mobile numbers only.

Delivery. Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and device, and we cannot guarantee that every message will arrive.

Privacy. We do not share your phone number or your text opt-in with third parties or affiliates (any other company, whether or not it is connected to us) for marketing or promotional purposes. Your text choices apply only to BrightTurn. For details on how we handle your information, see our Privacy Policy.

AI-assisted messages. We may use artificial intelligence to help write our texts.

Email and phone communications

If you give us your email address or phone number, we may contact you about your request and, unless you tell us not to, about our services. Unsubscribing from our emails stops all marketing from us on every channel. Depending on how you unsubscribe, it may also stop other emails from us, such as audit results or appointment details. If you still want those by email, contact us at hello@brightturnworks.com. We may record calls as described in our Privacy Policy, and we tell you at the start of every recorded call. We may use artificial intelligence to assist in these communications.

Privacy and website analytics

Our Privacy Policy describes what information we collect, how we use it, and your choices. Our website uses Google Analytics and the tracking tools in our customer relationship software to understand how visitors use the site. The Privacy Policy explains these tools and how to limit them.

Our content

The website and its content, including text, graphics, logos, and the design of the site, belong to BrightTurn or its licensors and are protected by intellectual property laws. You may view and print pages for your own use in evaluating our services. You may not copy, modify, distribute, or use our content for any other purpose without our written permission. The BrightTurn name and logo are our trademarks.

Information you submit

When you submit information to us, such as your business name, website address, and details about your business, you give BrightTurn permission to use it to respond to you, prepare your free audit, provide the services you request, and improve our services, as described in our Privacy Policy. You confirm that you have the right to share the information you submit.

Use of artificial intelligence

We use software tools, including artificial intelligence, to prepare audits and other materials. We review our work.

Third-party sites and tools

The Services may use tools or link to websites run by other companies. We do not control them and are not responsible for their content, policies, or availability.

Disclaimers

The Services, including the free audit, are provided “as is” and “as available.” To the fullest extent the law allows, BrightTurn disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the Services will be uninterrupted, error-free, or secure, or that any particular business result will follow from using them.

Information we provide reflects the public information available at the time it was created. It may contain errors or become out of date, and it is not a promise of any result. You are responsible for deciding whether and how to act on it.

Some states do not allow certain warranty disclaimers, so some of the above may not apply to you.

Limitation of liability

To the fullest extent the law allows, BrightTurn will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from or related to these Terms or the Services, even if we were told such damages were possible.

To the fullest extent the law allows, BrightTurn’s total liability for all claims arising from or related to these Terms or the Services will not exceed one hundred dollars ($100).

Some states do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to defend and indemnify BrightTurn against claims, losses, and reasonable costs, including attorneys’ fees, arising from your breach of these Terms, your misuse of the Services, or information you submit that you did not have the right to share.

Governing law

These Terms are governed by the laws of the State of South Dakota, without regard to its conflict of laws rules, except where federal law, including the Federal Arbitration Act, applies.

Resolving disputes

Before any formal claim. If you have a concern, please contact us first. We will try to resolve it informally within 30 days of receiving written notice that describes the problem and what you are asking for.

Mediation (optional). After the 30-day informal step, either of us may propose mediation by written notice. Mediation is voluntary and not binding, and the mediator’s fees are split equally unless we agree otherwise. Proposing mediation does not stop either of us from starting arbitration or a court case.

Arbitration

Please read this section carefully. It affects your rights, including your right to go to court and your right to join a class action.

Agreement to arbitrate. If a dispute is not resolved informally or through mediation, either you or BrightTurn may require that it be resolved through binding individual arbitration instead of in court, by written notice to the other, including after the other has started a court case. If neither of us requires arbitration, either of us may bring the dispute in the state or federal courts located in Codington County, South Dakota. This is subject to the rest of this section.

Arbitration administrator and rules. Arbitration will be administered by the American Arbitration Association (AAA) or JAMS, as chosen by the party that requires arbitration (the “arbitration administrator”), under its applicable rules, including its rules for mass or multiple filings. The arbitration administrator assigns the arbitrator under those rules. We may agree in writing to use another administrator. If neither AAA nor JAMS can or will serve and we cannot agree on another, a court will appoint the arbitrator under the Federal Arbitration Act. Hearings will be held by video or phone unless the arbitrator decides an in-person hearing is necessary, in which case it will be held in a location reasonably convenient to you, chosen by the arbitration administrator. Fees will be paid as the arbitration administrator’s rules require.

Multiple claims. If similar claims are filed in numbers that qualify as a mass arbitration under the arbitration administrator’s rules, those rules apply, including any procedures for handling the claims in groups or resolving a small number first to guide resolution of the rest.

Small claims. Either party may bring an individual claim in small claims court instead of arbitration, if the claim qualifies.

Individual claims only. You and BrightTurn agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, collective, or representative proceeding.

Your right to opt out. You may opt out of this arbitration agreement by sending written notice to hello@brightturnworks.com within 30 days after you first agree to these Terms. Your notice must include your name, mailing address, and a clear statement that you are opting out of arbitration. Opting out does not affect any other part of these Terms.

Exceptions. Either party may seek relief in court to protect its intellectual property, or to stop unauthorized use of the Services.

If this section is limited. If any part of this arbitration agreement is found unenforceable, the rest remains in effect, except that if the class action waiver is found unenforceable for a claim, that claim will proceed only in the state or federal courts located in Codington County, South Dakota, and not in arbitration.

Ending access

You may stop using the Services at any time. We may suspend or end your access to the Services at any time if you break these Terms or if we stop offering the Services. The sections on our content, information you submit, disclaimers, limitation of liability, indemnification, governing law, and resolving disputes continue to apply after your access ends.

General terms

  • Relationship to other agreements. These Terms govern your use of the Services. If you hire us, a separate written agreement covers that engagement. It adds to these Terms and, if the two conflict, it controls for that engagement, except that the section on our text messaging program always applies to the texts we send.
  • Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
  • No waiver. If we do not enforce a part of these Terms, we have not given up our right to enforce it later.
  • Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example if BrightTurn is sold or merges with another business.
  • Notices. We may send you notices by email or by posting them on the website. You may send notices to us using the contact details below.
